General Terms and Conditions of BEAUSANCY


  • 1 Applicability to entrepreneurs and definitions

(1) The following General Terms and Conditions apply to all deliveries between us and a consumer in the version valid at the time of the order.

A consumer is any natural person who concludes a legal transaction for purposes that can predominantly neither be attributed to their commercial nor their independent professional activity (Section 13 of the German Civil Code).

(3) The presentation of goods in our online shop does not constitute a legally binding contractual offer on our part, but is merely a non-binding invitation to the consumer to order goods. By ordering the desired goods, the consumer submits a binding offer to conclude a purchase contract.
(4) Upon receipt of an order in our online shop, the following provisions apply: The consumer submits a binding contractual offer by successfully completing the ordering process provided in our online shop.

The order is placed in the following steps:

1) Selection of the desired goods
2) Confirm by clicking the “Order” button
3) Checking the information in the shopping cart
4) Press the “Checkout” button
5) Log in to the online shop after registering and entering your login details (email address and password).
6) Re-examination or correction of the respective entered data.
7) Binding submission of the order by clicking on the button “order with payment” or “buy”

Before submitting the order, the consumer can return to the website where the customer's information is recorded by clicking the "Back" button in their internet browser after checking their details. They can correct any input errors or cancel the order process by closing the internet browser. We will immediately confirm receipt of the order via an automatically generated email ("order confirmation"). This email constitutes our acceptance of your offer.

(5) Storage of the contract text for orders placed via our online shop: We will send you the order details and our General Terms and Conditions by email. You can also view the General Terms and Conditions at any time at http://www.beausancy.com/pages/agb. For security reasons, your order details are no longer accessible via the Internet.


  • 3 Prices, shipping costs, payment, due date

(1) The prices quoted include statutory sales tax and other price components. Any shipping costs are added.

(2) Subject to Sections 6 and 7 of these General Terms and Conditions, the customer has the option of paying via PayPal, credit card (Visa, American Express, MasterCard), Klarna, and Apple Pay via the "Safari" internet browser. The respective terms of use of the payment service apply. Further information about Klarna can be found at the end of the General Terms and Conditions ("Information about Klarna").



  • 4 Delivery

(1) Unless clearly stated otherwise in the product description, all items offered by us are ready for immediate dispatch. Delivery will take place within 7 working days at the latest. In the case of advance payment, the delivery period begins on the day after the payment order is sent to the bank responsible for the transfer, and for all other payment methods, the delivery period begins on the day after the contract is concluded. If the delivery period falls on a Saturday, Sunday, or public holiday at the place of delivery, the delivery period ends on the next working day.

(2) Express shipping: Parcels placed before 2 p.m. on a working day (except Saturday) are usually delivered within Germany within 24 hours. Orders placed before 2 p.m. on a Friday will therefore not be delivered until Monday.


(3) The risk of accidental loss and accidental deterioration of the goods sold shall pass to the buyer only upon delivery of the goods to the buyer, even in the case of a sale by dispatch.

(4) In the event of delivery difficulties or if a product is no longer available, we reserve the right not to deliver the ordered product and to send you information about replacement products of the same or higher quality and price, which you can then order. If you do not wish to order such replacement products, we will refund any amounts you may have already paid us for the unavailable products.

(5) Undeliverable shipments: If we are unable to make a delivery, we will hold your delivery in our warehouse for up to 10 days. In this case, a notice will be left for you stating where your order is and how you can collect it. If you do not contact us to arrange delivery, we will assume that you wish to terminate the contract, and the contract will then be deemed to have ended. As a result of the termination of the contract, we will refund the purchase price paid as soon as possible and in any event no later than 30 days from the date on which the contract is deemed to have ended. In such cases, we are entitled to charge you for all delivery costs and other costs resulting from the termination of the contract.

  • 5 Retention of title

We reserve ownership of the goods until the purchase price has been paid in full.

  • 6 Right of withdrawal of the customer as a consumer:

BEAUSANCY does not cover return shipping costs.

The customer is free to choose which provider he uses for his return shipment.

For promotions with multiple products, partial returns will be refunded with a BEAUSANCY voucher.

If your return falls below a minimum order value, your discount code will expire.

Consumers have a right of withdrawal in accordance with the following provisions, whereby a consumer is any natural person who concludes a legal transaction for purposes that can predominantly be attributed neither to their commercial nor to their independent professional activity:

You have the right to withdraw from this contract within fourteen (14) days without giving any reason.

The cancellation period shall be fourteen (14) days from the day on which you or a third party other than the carrier designated by you takes possession of the goods.

by means of a clear statement (e.g., a letter sent by post, fax, or email) of your decision to withdraw from this contract. You may use the attached model withdrawal form, but this is not mandatory.

Consequences of revocation

If you cancel this contract, we will refund all payments we have received from you, including delivery costs (with the exception of additional costs resulting from your choice of a delivery method other than the cheapest standard delivery offered by us), promptly and at the latest within fourteen days from the day on which we received notification of your cancellation of this contract. For this refund, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; under no circumstances will you be charged any fees for this refund.

We may refuse to refund until we have received the goods back or until you have provided evidence that you have returned the goods, whichever is the earlier.

You must return or hand over the goods to us promptly and in any event no later than fourteen days from the date on which you notify us of the cancellation of this contract. This deadline is met if you send the goods before the expiry of the fourteen-day period.

You shall bear the direct costs of returning the goods.

In the event of a cancellation of partial shipments where a discount code is applied to the cheaper product, the cheaper product will be charged at the full price and only the difference will be refunded if the higher-quality product is canceled.

Example:

Product A costs €40, product B costs €30, and thus receives a 50% discount. This results in a total purchase value of €55 (€40 + €15).

If you cancel product A, valued at €40, you will be charged the full price for product B (€30 instead of €15). This means that only €25 will be refunded for product A.

  • 12 Limitation of Liability

(1) We shall be liable to the customer in all cases of contractual and non-contractual liability in the event of intent and gross negligence in accordance with the statutory provisions for damages or reimbursement of wasted expenses.

(2) In other cases, unless otherwise provided in paragraph 3, we shall only be liable for breaches of a contractual obligation whose fulfillment is essential for the proper execution of the contract and on whose compliance you as a customer may regularly rely (so-called cardinal obligation), and shall be limited to compensation for foreseeable and typical damages. In all other cases, our liability is excluded, subject to the provisions of paragraph 3.

(3) Our liability for damages resulting from injury to life, body or health and under the Product Liability Act remains unaffected by the above limitations and exclusions of liability.

14 Final provisions

(1) Contracts between us and the customer shall be governed by the law of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods. The statutory provisions restricting the choice of law and the applicability of mandatory provisions, in particular those of the state in which the customer, as a consumer, has his or her habitual residence, remain unaffected.

(2) Should individual provisions of these General Terms and Conditions be invalid, void, or incomplete, the validity of the remaining provisions shall remain unaffected. The parties shall – if necessary, in due form – replace the invalid or void provision with a provision or fill the contractual gap with a provision that most closely achieves the economic purpose pursued by them. If the invalidity or voidness of a provision is based on a measure of performance or time (deadline or date), a legally permissible measure shall replace the invalid or void provision.
